Terms of Service
Effective date: October 17, 2026 Last updated: October 17, 2026
These terms govern your use of amirzulfiqarai.com and provide general conditions relating to inquiries about software development and AI-related services.
1. Introduction
This website is operated by Professional. These Terms of Service apply to general use of the website. A separate written proposal or service agreement may govern an individual client project.
By using this website, you agree to these terms to the extent permitted by applicable law. If you do not agree, please discontinue use of the website.
2. Services
The website provides information about my skills, portfolio, and technology services, which may include:
- Website and web application development.
- Full-stack and custom software development.
- Desktop and mobile application development.
- AI agents and AI-powered applications.
- Business process and workflow automation.
- API integrations, database development, and ERP solutions.
Availability and scope depend on the agreed requirements, technical feasibility, and project terms. Website descriptions, portfolio examples, and testimonials are informational and do not guarantee a particular result or future availability.
3. Acceptable Website Use
You agree to use the website lawfully and responsibly. You must not:
- Use the website for unlawful, fraudulent, or harmful purposes.
- Attempt unauthorised access to the website or its infrastructure.
- Interfere with website security, availability, or normal operation.
- Introduce malicious code or attempt to exploit vulnerabilities.
- Scrape or copy website content in a way that violates applicable law or others' rights.
- Impersonate another person or submit knowingly misleading information.
- Infringe intellectual property, privacy, or other legal rights.
I may take reasonable steps to restrict abusive activity or protect the website, subject to applicable law.
4. Intellectual Property
Unless otherwise stated, original website content, branding, graphics, written material, and portfolio presentation are owned by me or used with permission. You may view the website and share links to its public pages.
You may not reproduce, distribute, sell, modify, or republish protected materials without permission, except where permitted by law or an applicable licence.
Client projects
Ownership of source code, designs, documentation, and other project deliverables will be established in the relevant written project agreement. That agreement should address pre-existing tools, reusable components, third-party libraries, open-source software, and licensed materials. Payment alone should not be assumed to transfer every intellectual property right.
5. Project Inquiries and Agreements
Submitting an inquiry through the website does not create a binding commitment to accept or undertake a project. Before work begins, the parties should agree in writing on relevant details, including:
- Project scope and deliverables.
- Fees, currency, payment schedule, and applicable taxes.
- Milestones, timelines, and delivery conditions.
- Client responsibilities, access, materials, and approvals.
- Included revisions and charges for additional work.
- Testing, deployment, hosting, maintenance, and support.
- Intellectual property ownership and licensing.
- Confidentiality, data protection, cancellation, and termination.
An accepted proposal, contract, or service agreement will govern the relevant project. If it conflicts with these general terms, the project agreement takes precedence for that project to the extent of the conflict.
6. Payments and Refunds
Payments are arranged directly with clients or through an agreed external payment provider. This website does not currently provide a checkout or subscription service.
Before work begins, the project agreement should specify the fees, currency, deposit or advance payment, milestone deadlines, transaction charges, applicable taxes, third-party costs, cancellation conditions, and refund eligibility.
Refunds and cancellations will be handled according to the applicable written agreement and mandatory legal requirements. Nothing in these terms removes rights that cannot legally be excluded.
Clients should use payment details confirmed through the agreed communication channel and verify unexpected changes to payment instructions.
7. Scope Changes, Delivery, and Revisions
Project timelines are estimates unless expressly guaranteed in writing. Delivery may depend on the client's timely provision of information, approvals, access, content, and other required resources.
Requests that materially change the agreed requirements may require additional fees, revised delivery dates, or a written change order. Revisions, bug fixes, maintenance, ongoing support, and upgrades are included only to the extent stated in the project agreement.
8. AI Systems and Automation
AI agents, generated content, and automated workflows may produce inaccurate, incomplete, inconsistent, or unexpected results. Unless expressly agreed in writing, AI output is not guaranteed to be accurate, suitable for a particular purpose, or error-free.
Clients should review outputs and maintain appropriate human oversight for decisions involving legal, financial, medical, safety-related, or other significant consequences.
The project agreement should identify relevant limitations, third-party AI dependencies, usage charges, data-handling arrangements, testing requirements, and monitoring responsibilities.
Clients must not use services developed or supplied by me for unlawful purposes or in ways that violate applicable law, third-party rights, or relevant provider terms. Confidential or personal information should not be entered into a third-party AI service unless the client has appropriate authority and suitable data-handling arrangements.
9. Third-Party Services
Projects may depend on external hosting providers, APIs, AI models, automation platforms, payment providers, software libraries, or other services. These services may change pricing, functionality, terms, availability, or technical requirements.
Unless expressly agreed otherwise, I do not control independent third-party services and cannot guarantee their uninterrupted availability. The parties should agree on how relevant costs, outages, and changes will be handled.
10. Confidentiality and Client Information
Confidentiality obligations for client projects should be established in the applicable proposal, non-disclosure agreement, or service agreement. Each party should use reasonable care to protect confidential information received from the other party and use it only for the agreed purpose, subject to the agreement and applicable law.
This section does not replace a separate data-processing agreement where one is legally required.
11. Website Availability and Information
I make reasonable efforts to keep the website accessible and its content useful and current. However, I do not guarantee uninterrupted access, error-free operation, or that every item of information will always be complete or up to date.
I may modify, suspend, or discontinue website features when reasonably necessary, subject to applicable law.
12. Disclaimers
To the extent permitted by applicable law, the website is provided on an “as available” basis for general informational purposes. Portfolio examples, demonstrations, and service descriptions do not guarantee a particular result in another project.
Any express warranties, acceptance criteria, service levels, or performance commitments for paid work must be set out in the applicable project agreement. Nothing in these terms excludes a warranty or right that applicable law does not permit to be excluded.
13. Limitation of Liability
Nothing in these terms limits or excludes liability where doing so would be unlawful. To the extent permitted by applicable law, I will not be liable for indirect or consequential losses arising from general website use.
Liability for a paid client project, including applicable exclusions, caps, remedies, and exceptions, should be specified in the relevant project agreement. Any limitation must be interpreted consistently with applicable law and must not remove mandatory consumer or other legal protections.
14. Suspension and Termination
I may restrict or suspend access to the website where reasonably necessary for security, maintenance, legal compliance, or to address misuse. Termination of a client project, outstanding payments, refunds, return or deletion of client materials, and continuing obligations will be governed by the relevant written agreement and applicable law.
15. Governing Law and Disputes
These general website terms are intended to be governed by the applicable laws of Pakistan, subject to mandatory laws and protections that apply to a particular user or transaction.
The parties should first attempt to resolve disputes through good-faith communication. If a dispute cannot be resolved informally, it will be handled through the appropriate legal procedures and courts or other forums having jurisdiction under applicable law.
This clause does not remove mandatory rights or jurisdictional protections available to a client under applicable law.
16. Changes to These Terms
I may update these terms to reflect changes to the website, services, or applicable legal requirements. The updated version will be published on this page with a revised date. Where required by law or contract, notice or affirmative acceptance will be obtained before relevant changes take effect.
